FIRST VIOLATION:
A violator will remedy a violation by filing a Corrective Application, appearing before the IWWA and complying to the recommendations of the IWWA at double the fee ($225.00 plus appropriate State of Connecticut Fees) of an Application to Conduct a Regulated Activity. A violation will be lifted from the property record subject to verification of compliance by the Inland Wetlands Enforcement Officer.
One half of the doubled fee amount will be deposited into the special Inland Wetlands & Watercourses Agency fund designated by the municipality to receive said fine. In its discretion, the IWWA may waive the Corrective Application double fee penalty if good cause is demonstrated by the violator.
SECOND VIOLATION:
A second violation (repeat of original violation or new violation) on he same property will be fined a one time amount of $500.00 plus appropriate State of Connecticut Fees. A violator will remedy a violation by filing a Corrective Application, paying the fine, appearing before the IWWA and complying with the recommendations of the IWWA at double the Fee of an Application to Conduct a Regulated Activity. A violation will be lifted from the property record subject to verification of compliance by the Inland Wetlands Enforcement Officer.
THREE OR MORE VIOLATIONS:
Three or more offices (repeat of prior violation or new violation) on the same property will be fined $1000.00 plus appropriate State of Connecticut Fees. A violator will remedy a violation by filing a Corrective Application, paying the fine, appearing before the IWWA and complying with the recommendations of the IWWA at double the Fee of an Application to Conduct a Regulated Activity. A violation will be lifted from the property record subject to verification of compliance by the Inland Wetlands Enforcement Officer.
FAILURE TO RESPOND TO SECOND NOTICE OF VIOLATION:
In the event a violator does not respond to a SECOND NOTICE OF VIOLATION (Second letter notifying property owner of a violation on a property) or a CEASE & DECIST, the violator will be fined $100.00 (residential) $200.00 (commercial or industrial) per day until a Corrective Application is submitted to the Inland Wetlands Enforcement Officer.
DEFINITIONS
CORRECTIVE APPLICATION – A permit application used to authorize activity necessary to remedy the events caused to an inland wetland or watercourse due to a violation of the Inland Wetland & Watercourses Regulations of the Town of East Hampton. The Application fee is double that of a normal application and the additional monies collected are to be deposited into the Special Inland Wetlands Fund designed for the purpose of furthering and implementing the policies of the State of Connecticut inland wetland laws, and the Inland Wetland & Watercourses Regulations of the Town of East Hampton.
NOTICE OF VIOLATION – A notice mailed out when a violation is discovered requesting that the activity is stopped immediately and that the property owner/tenant/contractor or violator call the Inland Wetlands Enforcement Officer, attend the next meeting of the Inland Wetlands & Watercourses Agency or send a written response to the Agency. This notice informs the violator that additional enforcement proceedings follow including the implementation of fines
SECOND NOTICE OF VIOLATION – A notice mailed to a property owner/tenant/contractor or violator who has not responded to the first notice of violation.
