SECTION 6 - GENERAL ZONING REGULATIONS

Inland Wetland and Watercourse Protective Provisions shall be found in the Inland Wetlands and Watercourses Regulations for all uses.  Special provisions applicable to all uses within the Salmon River Protection Area shall be found in Sec. 9.  Aquifer Protection provisions shall be found in Sec.8. (effective 12/06/03)

6.2 - Compliance with Provisions of These Regulations

No building, structure or premises shall be erected, altered, raised, moved, placed, reconstructed, extended, enlarged, reduced, demolished, used, occupied, rented, leased, or sold, or shall any lot, parcel, tract or piece of land be used except in conformance with the regulations herein specified for the district, as shown on the official map referred to in Sec. 5.2 in which it is located.

6.3 - Reduction of Lot Area or Dimension

No lot, parcel, tract or piece of land shall be divided, reduced or altered except in conformance with these Regulations.

6.4 - Density

No more than one dwelling unit per lot shall be constructed or used per lot, except as expressly provided for in these Regulations.

6.5 - Interior Lots

6.5.1 - Area

Each interior lot shall contain twice the minimum lot area required for the zone in which it is located.

6.5.2 - Access

Each interior lot shall have access to a street.  Such access shall be part and parcel of such lot and shall be a minimum of twenty-five (25') feet wide and shall comply with Public Works standards, relative to grade and construction.  The length of the access shall be not less than the minimum lot depth for the zone in which it is located and shall not exceed six hundred (600') feet.  The area of such access strips shall not be used to satisfy minimum lot area requirements.

6.5.3 - Yard Requirements

The setback requirements found in Table 6.1 shall be observed. The lot line or lines most parallel to the street accessed by the lot shall be considered the front line for the purpose of computing setbacks.

6.5.4 -  Location

No interior lot shall be located to the rear of another adjacent interior lot.

Maximum number of adjacent rear lot access way shall be (2) two (Amended 4/3/02)

6.6 - Corner Lots


For the purposes of these Regulations, corner lots shall be considered to have two fronts and two sides when considering setbacks and yard dimensions.  Lots must have required frontage, per Table 6.1, on both streets.


6.7 - Corner Visibility

On a corner lot, no wall, fence, or other structure shall be erected; and no hedge, shrub, tree or other planting shall be maintained, between the building line and the street line, as to create a traffic hazard by obstructing the view. For the purposes of enforcing these Regulations, the opinion of the East Hampton Police Department and/or the East Hampton Traffic Authority shall prevail.

6.8 - Lots on Narrow Streets

In the case of lots fronting on streets less than fifty (50') feet wide, (street width includes pavement & right of way)the front yard required by Table 6.1 shall be increased by one half (1/2) of the difference between fifty (50') feet and the actual width of the street. (Amended 4/3/02)

6.9 - Projections into Yards

Nothing in these Regulations shall prohibit the projection of not more than one (1') foot into a required yard setback by pilasters, eaves, cornices or other architectural features.  Overhangs and cantilevers shall be allowed to project two (2') feet into the required front yard.

6.10 - Access to Lots

Access to lots, parcels, tracts or other units of land, from public streets, roads and highways must be made in compliance with these Regulations, the Town of East Hampton Street Standards, Town of East Hampton Subdivision Regulations and State of Connecticut D.O.T. Standards.  Responsibility to obtain proper permits for such access is the sole responsibility of the applicant for such access.  No unauthorized access will be permitted.

6.10.1 - Standards

The following shall apply to access from all lots to streets and roads.

A.  General:  Access drives shall be constructed such that the flow of road drainage is not impeded, water from the lot is not directed onto the road, safe sight distance is achieved, and the required number of vehicles, in accordance with Section 21, may be parked off the road in all weather conditions.

B.  Grade:  The apron section, which is that portion between the edge of the road pavement and the street line, or front line shall have a maximum grade of three percent (3%) slope.  The next ten (10) feet shall not exceed five percent (5%) slope, and the remainder shall not exceed fifteen percent (15%) slope.

C.  Surface:  The drive apron shall be paved with a minimum of two (2) inches, compacted depth, bituminous concrete.  The remainder of the drive will be surfaced as follows:

       0-10 percent slope; minimum of two (2") inches processed gravel or stone

      10-15 percent slope; minimum of two (2") inches bituminous concrete.

The Director of Public Works and/or the Planning, Zoning, and Building

Department shall have authority to increase these minimums as site conditions dictate. (Access to unpaved roads or streets shall comply with any or all requirements of the Public Works and/or the Planning, Zoning and Building Dept.

6.11 - Two Family Dwellings/Duplexes

For the purpose of maintaining a balance of density in the R1, R3 and R4 Zones, lots created after October 28, 1987 on which two family dwellings/duplexes are constructed shall contain twice the minimum area and frontage specified in Table 6.1 for the applicable zone.

6.12 - Height Limitation

The building height limit shall be construed as the height of any part of a building or structure above the average finish grade of the lot.  Spires, cupolas, towers, chimneys, flagpoles, mechanical penthouses, ventilators and other similar features, occupying in aggregate not more than ten (10%) percent of the total roof area, and not used for human occupancy, may be erected to a reasonable and necessary height.

6.13 - Water Supply and Sewage Disposal

All lots used for residential, commercial or industrial purposes shall provide for adequate, healthful water supply and proper sewage disposal for the uses intended.  All lots and proposed uses shall comply with the provisions of all laws, codes, regulations, statutes and ordinances applicable to the proposed use.  The departments and/or agencies responsible for ensuring compliance to the above requirements shall include, but not be limited to, the Town Sanitarian, East Hampton Water Pollution Control Authority, State of Connecticut Dept. of Health Services, State of Connecticut Department of Public Utilities Control and the State of Connecticut Department of Environmental Protection.

6.15 – Lots in two zones

Lots which are located in 2 zones shall be subject to the requirements of the more restrictive zone.
