SECTION 24- TIMBER HARVESTING
24.1 -Purpose

The purpose of this Regulation is to protect the forests of the Town of East Hampton from improper forestry practices and to ensure that this important resource is managed with consideration for the future.

24.2 - Applicability

All proposals for the cutting, clearing or alterations of any forested area of the Town, in any zone, will be subject to action by the Commission, in the form of a Special Permit in accordance with Section 29 of these Regulations.

Exceptions:

1.      The cutting and/or clearing of trees and forested areas not in excess of three-fourths (3/4)    acres, for the purpose of establishing a house and yard site.

2.      The cutting and/or clearing of trees and forested areas as part of a site plan approved by the Commission.

3.      The cutting and/or clearing of trees and forested areas which occurs as part of a program to control disease when reviewed and approved by the Cooperative Extension Service, USDA, SCS, etc.

In addition to the review requirements of Section 29, the Commission shall refer all forestry proposals to the Conservation Commission for review and advisory. It shall be the responsibility of the applicant to provide all required information to the Conservation Commission.  The parameters for granting a Special Permit shall be the applicant's ability to show that the proposal has been designed in accordance with the most recent information available to ensure that the activity will exercise what is considered "Best Management Practices".

24.3 - Special Permit

Permits issued under this Regulation shall be valid for a period not to exceed one year.  Permits are renewable by the Commission upon receipt of evidence of compliance with the proposal as approved.  Plans showing the extent of progress, photographs and/or a report by the Town Enforcement Officer shall satisfy this requirement.  A progress report showing measures taken to comply with the provisions of the proposal, erosion control measures, skid road maintenance, number of acres cut, stump disposal, etc., shall be kept on site and shall be made available to the Commission or its designated agent upon request.

24.4 – Minimum Requirements (effective 12/06/03)
        
1.      General:
        a.      Property owner and address, applicant name and address

b.      Timber Harvester name and address, purchaser of timber and address, plan designed by.

c.      Acres of property, acres to be logged, how many times logged and when.

d.      Presented type and species of trees, stand appearance and density, present stand and description.

e.      Wildlife, use considerations.

f.      Operability of site, visual perception from street.

2.      Map information:

        a.      Location map, topography, assessors map (map, block, lot #) SCS map, wetlands crossings, 100ft upland review area, soils survey, existing and proposed woods roads, landing area.

3.      Harvest Operations:
        
a.      Purpose, products to be removed, number of trees and board feet, maximum height of slash.

b.      Machinery type, days and hours of operations

4.      Wetlands Information:

        a.      Refer to Inland Wetlands and Watercourses Regulations

24.5 - Enforcement

Failure to comply with the proposal as approved shall result in revocation of the permit.
