Ordinance of Lake Pocotopaug Commission

LEGAL NOTICE

At the Regular Meeting of the East Hampton Town Council on Tuesday, May 23, 2006, the Following Ordinance was Adopted:


4.19 AN ORDINANCE ESTABLISHING THE LAKE POCOTOPAUG COMMISSION


Section 1 - Name

The Commission shall be known as the Lake Pocotopaug Commission.


Section 2 – Purpose and Goals

The goal of the Commission shall be to provide a Lake and Watershed Management Plan that protects the environmental aspects of the Lake ecosystem and watershed area, improves water quality, and ensures appropriate ongoing maintenance and monitoring.

Said Commission shall evaluate and monitor the environmental and biological needs and conditions of Lake Pocotopaug and actively investigate grant opportunities.  It shall seek input and establish relationships when necessary with State agencies, hired consultants, and town organizations and commissions to create necessary Lake Protection programs or actions to abate algae and aquatic weed growth, improve fish populations, and combat existing and potential sources of pollution.  It may make recommendations to the IWWA and other town agencies and commissions with respect to all applications submitted to the Commission in accordance with the terms of this ordinance.

Said Commission shall, on a periodic basis, but not less than annually, report to the Town Council the environmental conditions of Lake Pocotopaug and its watershed, any changes in conditions, and recommend steps to remediate or improve such conditions.

Said Commission shall assist in or conduct water quality management studies, establish educational programs and disseminate information regarding the care, preservation and protection of the Lake by area residents and the public.

All applications submitted to the East Hampton Inland Wetlands and Water Courses Agency relating to and/or affecting the Lake Pocotopaug Watershed area, shall be submitted to the Lake Pocotopaug Commission within five business days of receipt by the Inland Wetlands and Water Courses Agency. Any Lake Pocotopaug Commission advisory opinion shall be rendered in sufficient time to enable the IWWA and other town agencies and commissions to review and act upon the application within the time prescribed by state statute when applicable.


Section 3 – Membership and Appointments

The Lake Pocotopaug Commission shall consist of seven (7) members appointed by the Town Council. Each of the said commissioners shall serve without compensation and shall be electors of the Town of East Hampton. The initial terms of office of the members of the commission shall be as follows: the first two (2) persons named shall serve for a term of four (4) years; the next three (3) persons named shall serve for a period of three (3) years; the remaining two (2) persons named shall serve a period of two (2) years.  No less than four (4) commissioners shall reside within the watershed area, two (2) of which shall reside on direct waterfront property. In determining the Lake Pocotopaug Watershed, the Town will use the contours on the United States Geological Survey Map.  
All subsequent appointments shall be for a four (4) year term. All members shall serve until their successors have been appointed and the appointments have been confirmed by the Town Council. Vacancies occurring other than by the expiration of a term of office shall be filled by Town Council appointment and confirmation. Such appointments shall be effective for the unexpired portion of the term.

The Town Manager shall assign staff support to the Commission ex officio, as he shall deem necessary to ascertain the work and operations of the Commission. The Town Manager, as Chief Executive of the Town, shall serve as a member of the Lake Pocotopaug Commission ex officio, without voting privileges.


Section 4 - Organization

The office of the Lake Pocotopaug Commission shall be at the East Hampton Town Hall, where all Commission records, maps, etc. will be filed or recorded in the office of the Town Building of Planning and Zoning Department. Regular meetings will be held monthly at the East Hampton Town Hall or other appropriate town public building.
The Commission shall adopt bylaws, regulations, rules, and procedures to carry out the purposes of this Ordinance. The Commission may submit a budget request to the Town Manager in accordance with the procedures set forth in the Town Charter.

The officers of the Commission shall consist of a Chairman and a Vice-Chairman. The Chairman shall preside at all meetings of the Commission and shall have the duties normally conferred by parliamentary usage on such officers. The Chairman shall have the authority to appoint committees, call special meetings, and generally perform other duties as may be prescribed by Commission bylaws. The Chairman shall be one of the Commission members and shall have the privilege of discussing all matters before the Commission and of voting thereon.

The Vice-Chairman shall act for the Chairman in his or her absence and shall have the authority to perform the duties prescribed for that office. He or she shall be a Commission member.


Section 5 - Attendance

Members shall notify Town Staff or the presiding Chair of his or her inability to attend regularly scheduled or special meetings. Attendance policy shall be in accordance with set Town policy.


This Ordinance will at effect 20 days following publication.
